The resource Valentino Rossi to delay the penalty received in the last Malaysian Grand Prix has been dismissed by the Court of Arbitration for Sport (TAS). After his controversial incident with Marc Marquez in Sepang, the Italian lost three points on her driving, with the result that it came out in the last position in the final race that will decide, in Cheste, if he or Jorge Lorenzo proclaimed world MotoGP champion 2015. On his arrival in Spain, on Wednesday night, ‘The Doctor’ was expecting that to be accepted your request and you can get out of the position I had achieved in qualifying this Saturday: “Would be the right”. But at the same time, he was aware of that could have to start from the bottom of the grill: “If I have to leave last, I will go out”. And so it will be.
The TAS received in Lausanne (Switzerland), Rossi and, after listening to your defense and your lawyer Massimiliano Maestretti (former legal adviser of the Scuderia Ferrari in Formula (1), considers that there are reasons why this sanction should be suspended…even though it leaves open the arbitration procedure.
Text partial TAS:
The Court of Arbitration for Sport (CAS) has dismissed the petition of Valentino Rossi to suspend the execution of the sentence issued by the Comusarios Sports of the FIM on the 25th of October 2015. In consequence of this, the decision of such commissioners to impose three points on the card of Valentino Rossi for the incident with Marc Marquez during the Malaysian Grand Prix is held, and Valentino Rossi will start the next grand prix of the season, which will be held in Valencia (Spain) between the 6th and the 8th of November, from the last position of the grill.
(…) The referee of the TAS found that did not occur conditions to suspend the sanction, which means that you need to be fulfilled in the next Grand Prix in Valencia. The arbitration procedure is still in progress and will take a final decision on the merits of the case later.
