The combination of alcohol and drugs at the wheel in our country is nothing new, it’s a problem almost as old as the existence of the car, because culturally speaking, it is something very ingrained in our society. In recent years, the consumption at the wheel has been reduced, in part by tougher legislation and the points driving license.
however, there remains a collective that puts in danger to others and themselves because they’re still drinking and/or taking drugs, and continue driving. We’re not talking about occasional users or recreational, but to those who have a dependency problem and can’t stop doing it. That people continue to renew the card, they get caught or not get caught.
The current legislation already provides for this in the General Regulation of Drivers, specifically in Annex IV.11:
“will Be the subject of special attention of disorders of dependence, abuse, or disorders induced by any kind of substance. In cases that present a history of dependence or abuse, you will be able to obtain or extend the permission or license provided that the situation of dependence or abuse has been extinguished after a period of demonstrated abstinence and there are no sequelae and irreversible that they pose a risk to road safety. To ensure these ends will require a favourable opinion from a psychiatrist, a psychologist, or both, depending on the type of disorder.”
What is the problem? To demonstrate the absence of addiction, you need to take blood samples at the time of renewal of the permit, which in practice is not doing. Therefore, hence, there is a gap that a new regulation will solve.
the minister of The Interior, Juan Ignacio Zoido, and the director of the DGT, Gregorio Serrano, will promote in the coming month the procedures to promote a legal update that will prevent those drivers dependent to get the permit renewed for up to overcome your addiction with the help of professionals. The standard could be ready this year if the political groups agree.
Under the current system, the only way of withdrawing from the circulation to the drivers who combine alcohol or drugs with the steering wheel, is that they are surprised in controls after having an accident or randomly. The positive alcohol-removed points, and to extinguish the balance, it can produce a withdrawal of the identification card. In the most severe cases can be a crime, for driving with the balance of points spent, or by passing over the legal limits.
The measure may seem very hard, to prevent the mobility of those drivers, but it’s to protect a higher good, the road safety. The intent of the legislators will continue to be the reintegration, so that those addicted to park your problem to get license back later.
In the state of the current technique still cannot ensure the mobility of all subjects in those conditions. There are already autonomous cars in a generalized way, the addicts could continue to travel whenever and when not to use the manual mode of the vehicle. The law can’t wait for that to happen.
To this day, for the duration of the period of withdrawal of the permit due to lack of renewal, the addicts will have to resort to public transportation, friends and family, taxis, or equivalent services (rental of vehicle with driver). These last options are not within the reach of all pockets on a regular basis.
Reminder of the legal limits for driving
Under Spanish law, consumption of drugs is regarded as binary: either there is presence or no presence, there is no difference whether there is influence or not. The detection of a non-authorised substance involves an offence against the road safety (Art. 379.2 CP), a 1,000 euro fine and loss of six points. No matter that the affected person go “perfectly” and you will have to fight in the courts.
In the case of alcohol, it allows a tolerance of up to 0.15 mg/l in air intake, to novice and professional, or 0.25 mg/l for the rest of the drivers. If it is exceeded in a first stretch that limit, they are 500 euros penalty and the loss of four points. If it happens more than once in a year, equivalent to double the legal limit before mentioned.
If you exceed the 0.3 mg/l in inlet air for beginners or professionals, or 0.5 mg/l for the rest of the drivers, the penalty rises to 1,000 euros and six points, but is not considered a crime. If more than 0.6 mg/l, regardless of the type of driver, is accused of an offence against the road safety, which implies a brand new criminal record and exposure to a prison sentence.
